Litigation and Alternative Dispute Resolution

There is risk inherent in any type of transaction, whether it is providing business services,  determining property ownership, probating an estate, collecting past due accounts, or selling property. Sometimes disputes arise regarding the terms of a transaction or the actions of one of the parties. If the parties cannot resolve the matter on their own, the parties can use other resources to resolve the dispute.

Many disputes can be settled without going to court through mediation or other alternative dispute resolution. In some instances, a third-party neutral mediator can assist the parties in seeing the strengths and weakness of their positions. A mediator can then guide the parties to an amicable resolution. Alternatively, the parties may elect for arbitration, which is like a fast-tracked court proceeding. It is helpful to have an experienced attorney in your corner to ensure you are getting the best deal and that any settlement definitively resolves all the outstanding issues without leaving you open to more problems later on.

Unfortunately, there are times when a settlement cannot be reached, and the parties must go to court. Our firm has extensive experience in a broad range of litigation matters. We have represented hundreds of clients in adversarial proceedings in state and federal court. Having an attorney represent you in court provides numerous advantages. Strict rules govern the actions of parties once you are involved in a lawsuit and these rules can be used by your attorney to your advantage. There are also numerous pitfalls that must be avoided during litigation. Sometimes, mistakes cannot be reversed, and an attorney can prevent those mistakes from ever being made.

Our attorneys have extensive experience in the following litigation matters:

  • Mediation and alternative dispute resolution
  • Drafting and serving complaints
  • Answering complaints and asserting counterclaims
  • Evaluating the likelihood of success of a party’s claims
